Terms and Conditions

These conditions of sale (hereinafter “Terms and Conditions” or “T&C”) have as their object the online sale of the products offered by

Maison TT SRL, with registered office in VICENZA (VI), VIALE ORTIGARA 5 CAP 36100, VAT number 04487670244, in the person of the legal representative pro tempore,

PREMISES AND CONDITIONS OF USE

The Seller is the owner of the website www.timoteomilano.com (hereinafter “Site”) which cannot be reproduced, either in whole or in part, transferred by electronic or conventional means, modified, linked or used without the prior consent of the Seller.
On the Site, Maison TT sells products and pursuant to Legislative Decree 9 April 2003, n. 70 containing the rules of electronic commerce (e-commerce) and Legislative Decree 6 September 2005, n. 206 (“Consumer Code”) as last amended by Legislative Decree 7 March 2023, n. 26, implementing Directive (EU) 2019/2161 of the European Parliament and of the Council, of 27 November 2019; with particular reference to Chapter I “Consumer rights in contracts”, articles 45 et seq.
By browsing the Site and completing the order, the Customer accepts these terms and conditions of use (hereinafter “T&C”).
Maison TT accepts orders from Customers who are consumers, who purchase on a personal basis. Pursuant to art. 3, paragraph I, letter a) of the Consumer Code, a Consumer is a natural person who acts for purposes other than any entrepreneurial, commercial, professional or artisanal activity that he or she may carry out.
The purchase of products is permitted only to persons who are 18 years of age or older.
All trademarks, logos, supplier and service names mentioned are trademarks of their respective companies and are the property of their respective rights holders.
The premises form an integral and substantial part of the T&C and the Customer declares to have fully read them and to accept their content without reservations.

TERMS OF SALE

The conditions applicable to the relationship between Maison TT and the customer are those in force on the date of transmission of the purchase order. They can be modified at any time and any changes are considered to be in force from the moment of their publication on the Site.
The forwarding of the order implies full knowledge and express acceptance of both the aforementioned general conditions of sale and of what is indicated in the purchasing procedure.

The Customer acknowledges and accepts that all communications relating to the purchase of the Products will be sent to the email address indicated at the time of transmission of the order , with the possibility of downloading the information on a durable medium in the ways and within the limits established by the Site.

OBJECT

These T&Cs define the contractual conditions applied to the online sale of products offered by Maison TT exclusively on its Site.
The Customer may purchase only the products displayed on the site at the time of browsing. It is specified that the image accompanying the description of a product has a merely illustrative function and may not be perfectly representative of its characteristics but may differ in color, size or in relation to any accessory products present in the figure due to the settings of the computer systems or devices used by the Customers. Therefore, for the purposes of the purchase contract, the description of the Product contained in the Site and, subsequently, in the order form sent by the Customer shall be valid.
The contract is executed with respect to the Customer identified by the data entered in the order form which is transmitted electronically upon acceptance of these T&Cs.

PURCHASING PROCESS

The Customer makes purchases on the Site as a “guest” without the need to register or as a registered user.

If the Customer is registered and logs into his account, his billing and delivery data will be displayed automatically and can be modified if necessary. If the Customer is not registered, he is asked to enter the data at each purchase.

After adding one or more products to the cart, the Customer views a summary of the details, choosing to modify the cart or continue with the order confirmation . Subsequently, to conclude the contract and definitively transmit the order, the Customer is asked, on a single page, to enter the information relating to the billing address (which may differ from the delivery address), the shipping location and the payment method with the related data. Following the order summary confirmation by clicking on the “ PAY NOW ” button, the Seller processes the payment for the order.
Correct receipt of the order is confirmed by the Seller by means of a confirmation communication via e-mail , sent to the e-mail address communicated by the Customer when completing the order form. From this moment on, the contract between Maison TT and the Customer is perfected .
The confirmation email contains the date and time of receipt of the order, a 'Customer Order Number', to be used in any further communication with the Seller, the link to the page of the Site containing these T&C accepted by the Customer, the information strictly necessary to summarise the essential characteristics of the product purchased, the indication of the price, the payment method used, the delivery costs and any additional costs. The message also reiterates all the data entered by the Customer at the time of confirmation of the order, who undertakes to verify its correctness and to promptly communicate any corrections by e-mail to the addresses of Maison TT.
The Customer, if registered, can check the status of his order by accessing his account under “_________________”.
Maison TT must be able to request more information by email or telephone, especially in order to correctly fulfill contractual obligations. Therefore, the Customer is required to enter real data in the order form.
Maison TT reserves the right not to process purchase orders that do not provide sufficient guarantees of solvency or that are incomplete and incorrect. In such cases, Maison TT undertakes to promptly notify the Customer. In the event of forwarding of the order form and payment of the price, Maison TT will refund the amount already paid.

ORDER AVAILABILITY AND CANCELLATION

All product orders are subject to product availability. The Site is constantly updated automatically in order to ensure maximum correspondence between the Seller's availability and that indicated on the Site.
The simultaneous access of many users-customers, as well as the variable quantity of each production based on the supplier company, modify the availability of the product, Maison TT does not guarantee the certainty of assignment of the ordered goods.
Maison TT may cancel the order in case of unavailability of the products, asking the Customer to leave an email address to be notified of the restocking.

Alternatively, Maison TT will inform the Customer by email that the contract has not been concluded and that the order could not be processed, specifying the reasons. In this case, before proceeding with the refund, the replacement with a similar product or other available solution is proposed as a solution that must always be expressly accepted by the Customer. In the event of non-acceptance of the replacement product, the amount that was previously committed to the Customer's payment method will be refunded . The refund will be communicated by email.

The order can also be cancelled following a request from the Customer to be sent to the email address of Maison TT in the event that the order has not been shipped; in other cases, the provisions set forth for the right of withdrawal apply.

PRICES AND PAYMENTS

The published prices indicate the price of the products, including 22% VAT.
Maison TT may modify the sales prices of the Products at any time and without notice and without the need for motivation and specification.
In the event that an incorrect and/or clearly derisory price is published , for whatever reason (system error, human error, etc.), the order will be cancelled, even in the event of initial validation.
The validity of the prices is always and only that indicated in the confirmation email that is sent to the Customer following the sending of the order.
The prices of the Products expressed in the individual product sheet do not include shipping costs which can, instead, be calculated and displayed in the order summary after adding the product to the cart and in any case before the order is confirmed by the Customer. Shipping costs can be modified at any time by the Seller, but the changes are not applied to orders already sent and accepted.
All purchases made on the site are safe, as they are guaranteed by SSL certification and respective HTTPS protocol . The payment methods proposed involve only multi-referenced circuits.
The Customer can pay by credit or debit card, Paypal, Shop Pay, Google Pay, even in the express checkout mode. It is understood that Maison TT remains extraneous to the contractual agreements that the Customer undertakes with the payment companies. Furthermore, the Customer guarantees to Maison TT that he has the necessary authorizations to use the payment method chosen for his order at the time of sending the order.
All orders are payable in Euros.
At no time during the purchase procedure is Maison TT able to access the Customer's credit card information, which is transmitted via a connection protected by an encrypted protocol directly to the site of the entity that manages the electronic payment. No computer archive of Maison TT will store such data.
For each order placed, Maison TT issues an invoice for the order shipped, sending it by email to the Customer who placed the order. For the details reported when issuing the invoice, the information provided by the Customer when processing the order is valid.

DELIVERY AND PROCESSING METHODS

The products sold on the Site can be delivered in the national territory and in the member countries of the European Union.
Unless otherwise specified in the order summary before making the purchase, shipping costs, where applicable, and any additional costs, are the responsibility of the Customer and are detailed before payment.
The payment for the goods by the Customer will be made using the method chosen at the time of ordering. Nothing more is due by the Customer than the total of the order shown at the end of the purchase procedure.
The purchased products are delivered to the address indicated by the Customer at the time of completing the order .
Maison TT undertakes to make deliveries within the times indicated and in any case always in compliance with the provisions of the Consumer Code. In some cases, delivery times may be subject to variations due to force majeure or due to traffic and road conditions in general or by act of the Authority, as well as for any delays attributable to the carrier.
The goods travel with packaging created by Maison TT based on the products ordered, their number and their weight/volume.
Maison TT reserves the right to modify the shipping policies at any time and to give appropriate notice, but the changes are not applied to orders already sent and accepted.
Delivery is deemed to have taken place or the order delivered through the acquisition by the Customer or the recipient of the order other than the Customer or, in any case, by a third party indicated by him of the material availability of the product which is proven by the signature (by one of the aforementioned subjects) of the order receipt at the agreed shipping address. Once the declaration of the subject to whom the goods are entrusted/delivered has been acquired, no responsibility in relation to the failure to receive the same can be attributed to Maison TT.
It is the Customer's responsibility - or the aforementioned subjects - to be available throughout the day on the days indicated for the collection of the products at the address specified at the time of purchase.
Any external damage to the packaging and/or the product or the discrepancy in the number of packages must be immediately contested to the courier who makes the delivery, by adding the wording Any damage to the packaging and/or the product or the discrepancy in the number of packages or the indications, must be contested immediately, by adding a written reservation (SPECIFYING THE REASON, e.g. " holed packaging ", " crushed packaging ", etc.) on the courier's proof of delivery.
Once the courier's document has been signed, the Customer cannot raise any objection regarding the external characteristics of the goods delivered. Maison TT reserves the right to request further documentation from the Customer to prove the actual damage.
In case the Customer provides an incorrect shipping address, the order will be delayed and additional shipping costs will be calculated. In case of return to sender, it is not possible to request a refund of the return costs.

RIGHT OF WITHDRAWAL

The Customer has the right to change his mind for any reason within 14 days of receiving the products, without any penalty, to be exercised as indicated in the following paragraph .
The Consumer must send a request to the Maison TT email address with the following content:

Once the email is received, Maison TT will send the Customer the instructions for the correct exercise of the right of withdrawal and the instructions for booking the courier or requesting assistance. The product arrives at the Seller's headquarters where the return is processed.
For any assistance requests relating to the granted return, please contact Maison TT.
Maison TT will refund the Customer the amount already paid for the purchase of the goods, including delivery costs, in compliance with legal obligations, using the same payment method used by the Customer, unless otherwise agreed.

LEGAL GUARANTEE OF CONFORMITY

All products purchased by the Customer are covered by the legal guarantee for defects of conformity, pursuant to Legislative Decree 206/2005 and subsequent amendments, Part IV, Title III.
In the event of receipt of an incorrect product compared to that ordered ( to be understood as the only case in which the error is attributable to the Seller ) or damaged (for reasons attributable to the Seller or the courier) or altered or, in general, non-compliant (e.g. missing stitching, loose snap hook, etc.) the Customer-Consumer must exercise direct action to assert the defects not fraudulently concealed by the seller within 26 months of delivery. Pursuant to art. 135 c. 1 of the Consumer Code, the lack of conformity communicated by the Consumer is presumed to exist within one year from the date of delivery of the product, unless proof to the contrary is provided by the Seller of the incompatibility of the defect with the nature of the goods or with the nature of the lack of conformity.
In any case, the Customer has the obligation to attach to the email with which he asserts the lack of conformity appropriate photographic and/or video documentation from which the error or defect is clearly evident.
The legal guarantee applies to products that present a lack of conformity, provided that the product itself is used correctly, in compliance with its intended use and as provided in any accompanying documentation.
In the event of a lack of conformity, Maison TT will provide, at no cost to the Customer, for the restoration of the conformity of the product through repair/replacement or reduction of the price, up to the termination of the contract and the consequent reimbursement.
In the event that, for any reason, the Seller is unable to return to its Customer a product under warranty (repaired or replaced), the Seller may proceed at its own discretion to refund the amount paid taking into account the use of the product or to replace it with a product of equal or superior characteristics.
In cases where the application of the guarantees requires the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment, etc.); to limit damage to the original packaging, it is recommended to insert it in a second box; in all cases, the affixing of labels or adhesive tapes directly on the original packaging of the product must be avoided.

LIMITATION OF LIABILITY FOR ACTIONS NOT ATTRIBUTABLE TO THE SELLER

The Seller is not liable in the cases referred to in art. 118 letters b) and e) of the Consumer Code , respectively in cases where the defect that caused the damage did not exist when the Seller put the product on sale and when the state of scientific and technical knowledge, at the time the Seller put the product into circulation, did not yet allow the product to be considered defective.
The Seller is in no way responsible for any damage caused to the Customer, the Customer's animals or third parties, resulting from non-compliant use of the products.

REVIEWS

Maison TT only collects reviews from Customers who have actually purchased on the Site and are identifiable by email address, order code and purchase date.
The review must focus on the product received and not on the services (for example delivery) and is published under a pseudonym chosen by the Customer.
The Customer guarantees that any information, message, text, data made available on the Maison TT website via review is original and does not violate third party rights, for example copyright, intellectual property rights.
The Customer acknowledges that he/she is the author and solely responsible for each and every review transmitted, disclosed, exchanged or otherwise made available to Maison TT.
The Customer undertakes not to disclose and "post" Reviews containing sensitive data, as well as enter/publish content of a paedophilic, pornographic, obscene, blasphemous, defamatory, offensive nature, contrary to public order or morality, which promote or induce illegal activities or which contain viruses or other programs damaging the functionality of other people's computer systems.
Maison TT declares that it does not carry out editorial control on the Reviews in any case and does not carry out any control activity on the lawfulness, truthfulness, validity, accuracy, non-deceptiveness, non-offensiveness of the Reviews. In any case, Maison TT reserves the right to refuse and/or eliminate at its discretion the Reviews not deemed suitable pursuant to the law.
Maison TT declines all responsibility for damages, claims or losses, direct or indirect, arising to the Customer or third parties from the transmission, disclosure, exchange or making available of Reviews provided by the Customer.
The Customer who accesses the Site declares to be aware of the possibility that the reviews contain contents that the Customer deems inappropriate or that may offend the sensibilities of certain people, and in any case recognizes that the responsibility for the Reviews does not lie with Maison TT but with the respective authors.

ONLINE DISPUTE RESOLUTION

Pursuant to and for the purposes of art. 14 of EU regulation no. 524/2013, Consumer Customers residing in the Member States of the European Union are hereby informed that for the resolution of disputes relating to the contract concluded on the Site, there is the possibility of resorting to the Online Dispute Resolution (ODR) procedure, provided by the European Commission, and reachable at the following link: https://webgate.ec.europa.eu/odr/ . In compliance with the provisions of the aforementioned legislation, we also inform you that the ordinary email address of Maison TT is ______________________.

APPLICABLE LAW AND JURISDICTION

These T&Cs are governed by and construed in accordance with Italian law, without prejudice to any different prevailing mandatory rule of the country of habitual residence of the Customer.
For any dispute between the Customer and Maison TT, the court in whose district the Consumer has his/her residence or domicile shall have jurisdiction.
